About Urban Media's service

Jameson Creative LLC DBA Urban Media offers subscription-based service packages for marketing and advertising including marketing media assets for use in marketing, advertising, or otherwise promoting your business, products, services, issues, and/or personality. By stating ‘Urban Media’ these terms are referring to Jameson Creative LLC DBA Urban Media.

When you engage with Urban Media and our provided services, you accept the terms of our services. By engaging with Urban Media and the services provided, you agree to be bound by these terms.

 

Terms of service

Marketing & advertising plans prepared by Urban Media

Urban Media's proposed marketing and/or advertising plans and proposals are written and prepared by Urban Media for the purposes of presentation to both current and potential clients. All content, planning, pricing, and other intellectual properties contained within these documents are the property of Urban Media with the exception of the proposed client's name and branding which is used to customize presentations.

 

Subscription-based marketing, advertising, and multimedia production agreements

The services provided by Urban Media including marketing & advertising media assets created and used during your agreement are owned by Urban Media and/or the respective copyright holder if any third-party assets are used. The assets created to provide services are under Urban Media's terms of service. The terms of the agreement are not negotiable.

All service hours must be rendered within the month they are billed or within thirty calendar days of the date of purchase. If purchased service hours are not used, the hours are forfeited. Service hours do not roll over.

Your advertising spend is not included in the services provided within any Urban Media agreement. A suggested ad spend budget is recommended based on the size of your company’s advertising goals and agreed upon by the client prior to the execution of any ad spend.

Any additional work beyond the included service hours of your agreement will be billed at the standard hourly rate of $120 per hour. All additional billable work is first estimated and then approved by the client prior to proceeding.

You agree that Urban Media may use your company brand within these assets. You also agree that Urban Media has the right to use these assets for displaying work created by Urban Media for examples of services provided when marketing, advertising, and obtaining further clients.

By actively engaging with the services provided by Urban Media, you are providing your permission for Urban Media to perform marketing and advertising services for your business, company, brand, products, services, and/or personalities.

Urban Media holds rights to our creative properties. As a client, you will receive digital copies of designs upon request to be used for the duration of your agreement. Delivery is provided by online link only. You do not own these assets indefinitely. You are only allowed to use these assets while maintaining a paid and active agreement.

Assets created and uploaded to mass media outlets such as Youtube, Facebook, Instagram, and other digital platforms will not be removed from those platforms after your agreement has concluded, however, you are not permitted to continue usage of these assets for further active advertising efforts including, but not limited to paid advertising such as Google ads, YouTube ads, OTT advertising or any other paid advertising channel, nor are you permitted to create new digital postings of previously used marketing media assets.

 

Logo design services

If you are purchasing design services to be rendered for the purpose of creating a logo or logo package, you will receive digital formats of the design, delivered via email. The logo/brand may be used for business purposes for the duration of your time in business.

 

Video, audio, and photography services

All video, audio, and photography services rendered by Urban Media are for the purpose of marketing, advertising, or otherwise promoting your business, company, brand, products, services, and/or personalities. Urban Media does not provide raw footage, separated audio track-outs, raw photos, or any project files such as Adobe Premiere, Adobe After Effects, Adobe Photoshop, Adobe Lightroom, Avid Protools, or Studio One files. Urban Media does not provide any files on storage media such as physical hard drives, flash drives, CDs, floppy discs, hard discs, or other physical mediums.

As a client, you will receive digital files via online delivery for marketing and advertising usage only. You do not own the videos, audio files, or photographs. You may not sell, copy, redistribute, alter, or otherwise create derivative works from the provided digital files. If you have purchased a subscription-based marketing, advertising, or multimedia production agreement, the video, audio, and/or photo assets may be used for the duration of your agreement only.

When engaging with Urban Media as a featured person/personality in the production of audio, video, or photography services you grant permission to the rights of your image, likeness, and sound of your voice as recorded on audio or video without payment or any other consideration. You understand that your image may be edited, copied, exhibited, published, or distributed and you waive the right to inspect or approve the finished product wherein your likeness appears. Additionally, you waive any right to royalties or other compensation arising or related to the use of your image or recording. You also understand that this material will be used for marketing and advertising, mass media, and commercial broadcast settings within an unrestricted geographic area.

You agree that photographic, audio, or video recordings may be used for the following purposes:

• online marketing and advertising

• broadcast commercials and advertising

• case studies

• social media

• websites

• informational presentations

You agree that you understand this permission signifies that photographic or video recordings of you may be electronically displayed via mass media such as the internet or in marketing, advertising, broadcast settings, public settings, educational, and presentational purposes. You will be consulted about the use of the photographs or video recording for any purpose other than those listed above. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed. This release applies to photographic, audio, or video recordings collected as part of any production by Urban Media. By engaging as a part of the services Urban Media provides, you acknowledge that you completely understand the terms of the above release and agree to be bound thereby. You release any and all claims against any person or organization utilizing these materials for educational, mass-media, broadcast, or any marketing and advertising purposes.


Terms of sales, exchanges, and non-refundable service hours


All sales are final

All sales are final. Urban Media offers replacements for items damaged or lost in transit.


Exchanges

To be eligible for an exchange, you must first email us within 14 days of purchase or 7 days of receipt to alert us of the damage or other issue, then return the damaged item to Urban Media. Upon receipt of the damaged item, Urban Media will ship out a replacement.

Non-returnable items

Service hours purchased including, but are not limited to - monthly or yearly agreement service hours, or service hours purchased for the purpose of graphic design, web design, logo design, print design, apparel design, video production, audio production, photography services, SEO, SEM, advertising campaign management, social media marketing and/or social media management.
